Terms & Conditions

Last updated: 10 April 2025

Effective date: 10 April 2025

1. Definitions

In these Terms and Conditions:

2. Acceptance of Terms

By accessing this website or submitting an enquiry through it, you agree to be bound by these Terms. If you do not agree, please do not use this website.

To enter into an engagement for legal services, you must be at least 18 years of age and have the legal capacity to enter into a contract under Malaysian law.

3. Nature of This Website

This website provides general information about the services offered by Lineage Foundry. Nothing published on this website constitutes legal advice. Reading this website does not create a solicitor-client relationship. Legal advice is provided only under a formal engagement arrangement, confirmed in writing.

The information on this website is current as of the date shown. Laws and procedures change; we do not undertake to update every page immediately upon any change in Malaysian law.

4. Engagement for Legal Services

A solicitor-client relationship is formed only when we have confirmed an engagement in writing and you have accepted the terms of that engagement, including the stated fee. Until that point, any communication between us is pre-contractual.

We reserve the right to decline to take on any matter at our discretion, without being required to give reasons.

5. Fees

The fees for each service are as stated on this website at the time of enquiry. Fees are quoted in Malaysian Ringgit (RM) and are inclusive of our professional charges for the scope described. Disbursements — such as court filing fees, search fees, or stamp duty, where applicable — are charged separately and notified in advance.

Payment terms are set out in the engagement letter. Fees for additional work outside the stated scope are agreed in writing before that work proceeds.

6. Refund Policy

Where an engagement is terminated by the client before the work is complete, fees for work already carried out are payable and non-refundable. The amount payable will be calculated on a reasonable basis having regard to the stage reached. Where we are unable to proceed for reasons within our control, fees paid will be refunded in full for work not yet completed.

7. Confidentiality

All client information is held under professional confidentiality in accordance with the Legal Profession Act 1976 and the professional rules of the Bar Council Malaysia. We will not disclose client information to third parties except as required by law, with the client's consent, or as necessary to carry out the engagement.

8. Intellectual Property

All content on this website — including text, design, and structure — is the property of Lineage Foundry or its licensors. You may not reproduce, distribute, or republish any part of this website without our prior written consent. Documents prepared by us for a client are provided for the client's use only and may not be reproduced for other purposes without permission.

9. Disclaimer

The information on this website is provided for general information only. We make no representations or warranties about the accuracy, completeness, or suitability of the content for any purpose. Legal matters are complex and fact-specific; information on a website cannot substitute for advice tailored to your situation.

We do not warrant that this website will be available without interruption or that it is free from errors or malware.

10. Limitation of Liability

Our liability to you in connection with any legal services provided is limited by our professional indemnity cover and the terms of the engagement letter. We are not liable for indirect, consequential, or special loss arising from the use of this website or from general information published on it.

Nothing in these Terms limits our liability for fraud, personal injury caused by negligence, or any liability that cannot be excluded or limited by Malaysian law.

11. Links to External Sites

This website may contain links to third-party websites. We have no control over and accept no responsibility for the content or privacy practices of those sites. Links are provided for convenience only and do not constitute an endorsement.

12. Termination

We may withdraw access to this website at any time without notice. Either party may terminate an engagement by giving written notice to the other; fees for work completed to the date of notice remain payable.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or from a legal services engagement shall be subject to the non-exclusive jurisdiction of the courts of Malaysia, with the High Court in Penang being the preferred forum.

We encourage clients to raise any concern with us directly before initiating any formal process. Most matters can be resolved informally and promptly.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. The revised version will be published on this page with an updated date. Continued use of the website following any change constitutes acceptance of the revised Terms.
