OUR METHODOLOGY
How we approach each engagement.
The three services offered by Lineage Foundry address distinct stages in the life of a family's estate. They can be engaged independently — a client may come to us only for a will review, with no further intention at that time — or in sequence, as a family's circumstances develop over years.
Each engagement begins with a meeting in which we listen carefully before offering any assessment. We do not proceed from standard templates; the starting point is the client's situation as described to us. We then set out, in plain language, what we have understood, what the relevant legal landscape looks like, and what the available options are. The client decides what to do next.
WILL & DOCUMENT REVIEW
Review of Existing Wills and Estate Documents
A careful review service for individuals who have drafted wills at earlier stages of life and wish to consider whether the provisions remain consistent with their current circumstances and family relationships. The review examines the existing documents in their context, identifies any provisions that may benefit from revisiting, and offers a written note in plain language outlining matters the client may wish to consider.
No change is initiated without the client's direction, and the client retains full discretion over whether to proceed with any revision.
What the review covers:
- Examination of the existing will or estate documents in full
- Assessment of whether provisions remain appropriate to current circumstances
- Identification of any provisions that carry legal risk or ambiguity
- Written note summarising findings and considerations, in plain English
- One follow-up meeting to discuss the note's contents
How the engagement proceeds:
Initial meeting to understand the client's circumstances and receive the existing documents
Document examination and preparation of written review note (typically one to two weeks)
Second meeting to walk through the written note and address the client's questions
Client decides at their own pace whether any revisions are desired; no obligation to proceed
TRUST DRAFTING
Trust Drafting for Family Purposes
Drafting of trusts for clients wishing to arrange the long-term management of assets for family purposes — most often for the benefit of minor children, relatives with particular needs, or the preservation of a family property. The work begins with careful listening to the client's objectives, followed by a measured explanation of the structures recognised under Malaysian law and the practical implications of each.
Drafting proceeds at an unhurried pace, with time allowed for reflection and for conversation with family members where appropriate.
What the engagement covers:
- Explanation of trust structures recognised under Malaysian law
- Drafting of the trust instrument to the client's objectives
- Provisions for minor beneficiaries or relatives with particular needs
- Family consultation meeting where the client wishes this
- Review of draft before execution, with written explanation of each provision
How the engagement proceeds:
Initial meeting to hear the client's objectives and the family context
Written overview of applicable trust structures with explanation of implications of each
Optional family consultation meeting; drafting proceeds on confirmed instructions
Draft reviewed with client; revisions incorporated; final instrument executed
ESTATE DISTRIBUTION
Estate Distribution Guidance for Personal Representatives
Supportive guidance for personal representatives — executors and administrators — navigating the distribution of an estate under Malaysian procedures. The work includes explanation of the duties attaching to the role, practical support in correspondence with institutions and beneficiaries, and review of the distribution schedule before final steps are taken.
Given the personal circumstances in which representatives often act, meetings are arranged with care for their own emotional bandwidth, and written updates are provided between meetings.
What the engagement covers:
- Explanation of the legal duties of executors and administrators
- Assistance with correspondence to financial institutions and beneficiaries
- Review of the proposed distribution schedule before implementation
- Written update provided to the representative after each material step
- Support paced with awareness of personal circumstances
How the engagement proceeds:
Initial meeting to understand the estate, the role, and the representative's circumstances
Explanation of the duties of the role and the procedural steps required
Ongoing support with correspondence and written updates between meetings
Review of distribution schedule; final steps confirmed in writing before execution
